    I find it interesting that the sole passenger who had his seatbelt on escaped with only minor injuries.

    actually, the sole person that escaped with minor injuries had his seat belt on. a bit different. the other passenger is was killed and it didn't say whether or not he wore a seatbelt.

    in response to the memo thing: the big car companies do have, i think the word is 'actuaries', but could be wrong, that sit around doing mad statistics about known flaws and weaknesses in car models. they figure out, to the best of their ability, how many people will die and how many will be seriously injured because of said flaw or design weakness, and if the payout will be cheaper than it is to fix it - and that's what decides whether something is fixed, or made more safe, etc., unless of course someone wins a lg. case opening the door for more - then the whole industry corrects the issue. when you are on the side of the big company in an issue like this thing with derrick, remember that the car company already knew it was unsafe as well as consumer advocacy groups. now i agree it would be a lot better if someone who actually had their seatbelt on and wasn't speeding on ice brought this to court. in the end though, i'll be happy if suv's get better roofs - like i said earlier. (i also feel like - what a fucking idiot - driving like that on ice when you've got kids to provide for .....)

    exactly but under english law you have the responisbility for the results of your actions. If you put something out that can kill people then you must deal with the consequences. If indeed the design is faulty, then GM should be held responsible for the degree to which the design aspects contributed to the deaths.

    faulty? all cars are faulty as all cars can end up in accidents that kill people. chairs can kill people. desks, sofas, brooms, cups, books, teapots, houses, etc.

    in my mind, the gov't gave the seal of approval to the car if it met all gov't safety regulations. i don't believe somebody should be able to sue for something that is sanctioned by the gov't.
