New NBA Dress Code

    How is this a legal issue. If any company can require a dress code then the NBA can. All the NBA has to say is you must comply with our dress code if you wish to work here. Same as every other business. What this HOPEFULLY is, is a start in the right direction.

    Oh and AI needs to grow the hell up. He's a 30 year old man that dresses like an 18 year old.

    Actually the Supreme Court has only upheld dress codes in cases where they prevented disruptions and did not overly infringe upon the subject's rights. Tags is a lawyer, so I'm sure he's giving it consideration and is toeing the line as much as he can, but I still wouldn't be surprised to see it challenged in court. Certainly the NBA can require its employees to wear a certain uniform during games, but requiring them to wear apparel not provided by the league in all other league business appears to be on shaky constitutional ground.

    Then about every company in America is violating the constitution.

    Where in the consitution does it say anything about dressing at work anyway?

    My employer can dictate how I dress. If I don't like it, I can go find another job.

    [​IMG] I realize that you're just trying to be an ass because you're still upset about how stupid I've made you look in various arguments, but I'm going to pretend like you don't actually understand the distinction and therefore explain it to you.

    Companies are allowed to dictate certain broad standards to minimize disruptions and present a certain atmosphere. They are also allowed to employ more specific standards if they supply the clothing in question. What they can't do is to force their employees to only wear double breasted suits or skirts with a certain thread count, and their ability to control the appearance of their employees is also limited to the workplace itself.

    So in this case, is it constitutional for the NBA to require specific standards when it does not supply the clothing? It's a gray area at best. Is it constitutional for them to require athletes to abide by these standards even outside the arena in situations where they are construed to be on "league business"? I honestly don't know, as I'm not a lawyer.


    Please tell me that you are aware that the Constitution was never limited to what it explicitly spells out.

    If a company wants to set a certain standard and set rules then the employees follow them or they get fired or fined. These guys are such big over paid babies and oh yeah the minimum for one of these big babies on a 10 day contract is $35,000. Oh, these poor babies can't go out and buy the necessary clothing for even that "small" amount? Please! Don't make excuses for these grown men that are getting enormous amounts of money because the have a very specialized athletic skill. They should be thankful for the opportunity and do whatever company or corporation says as far as the rules and regulations that are set forth to be able to make the gobs of money that they make. I make a fraction of what most of these mega-cry-babies do but I still have to buy clothes and dress nicely at work and any time that I am out representing my workplace in public. I don't sit around and cry about it like the punk who thinks that he is so hard because he went to kiddie prison for starting a gang riot in a public place in Virginia Beech. And the other poor baby crying about a clothing stipend, it is totally and utterly ridiculous to whine about a clothing stipend even for the 10 day contract players. If I was a person signed to a 10 day contract I would be ecstatic and if one of the things I had to do was to go out and purchase a few articles of clothing to wear when I was out in an official capacity with the team that is hiring me then its a no brainer: the clothes would be bought. The fact that this is even an issue is ridiculous as is the fact that I have wasted a few minutes of my time typing this up. :banginghe
