    It was not may mom's fault, the insurance company is the one that belongs to the guy who hit her. It is not her own company that is doing this.

    The car was paid for. So she was not upside down. You do not get retail value when you trade your car in but that is a voluntary action. When some guy hits you in the back and totals your car you have no choice about it.

    Can you call your (Mom's) insurance company and see if you can file it with them?

    I doubt she had anything but liability insurance on it since it was an older vehicle. She has an appointment with an attorney tomorrow. Maybe he can help.
