So I Get This Phone Call Today

    It seems my name on a Kohl`s account from 1998 is going to cost me. My exwife and I have been divorced since 2000. She ran up the account to over $1000 and hasn`t made a payment in over a year and now they`re giving me till the end of this month(2 days) to pay a settlement of $960. WTF!
    I`ve used the card once in the last 5 years to buy some t-shirts. The only reason I used the card then was get an extra discount.
    She has run into trouble the last couple of years and has recently filed bankruptcy.
    Am I screwed? Because I`m not paying them a damn cent.

    If they've given you previous notices and this is the final one, then you're screwed. On the other hand, if it's a collection agency that just got the account from Kohl, it's probably just a scare tactic.

    Today was the first I`ve heard about it. All the notices were going to her address.

    Is this a joint account? or is it yours? If it is just yours, has she ever been an authorized user of the card/account?

    Evidently it is(was, until today) a joint account. The guy who called from Kohl`s wasn`t even aware of a divorce. If I had only been made aware of the situation sooner I could`ve taken steps to get them the correct info.

    Did you use the card during this statement's time? If so, seems you'd be responsible for your purchases only. If that can't be determined it'd be a 50-50 split. Because your ex didn't tell you of the bill, you might even make her responsible for the whole tab, if you want to take her to court. In the meantime, it still ain't gonna take you off the hook with the credit card company. I doubt that they give a shit who received their statement. They only know that they sent it and it was received.

    Thanks. I printed it out. Looks like I`ll be on the hook for Kohl`s until 2015. It also shows the account was shut down back in April of this year. Thank goodness Kohl`s was the only one showing up on the report that wasn`t a green color.
    Its a good thing I haven`t a need for credit cards or any loans.

    I haven`t use the Kohl`s card in a few years and even then it was for around $60 and was paid off the next statement. I guess they will try to get it from me and if it was a much smaller amount I`d pay it off for her. I noticed from the credit report that the total was $1570, but they would take a settlement of $960. They`re not getting it from me.

    offer them $100 to settle AND GET IT IN WRITING...someone will take it sooner or later and it makes you look, proactive. bombard them with mail and disputes...cry them a river, if you will about the divorce, :blah: :blah:

    report them to BBB for violation of FDCPA. make them earn that $100.
